Article 1 - Purpose
The general conditions of sale detailed below apply to all orders placed on the website arabian-luxperfumes.
These conditions apply to all items and services offered on the site, or other company media, unless otherwise agreed in advance.
These terms and conditions appear on our sales site and are systematically proposed when you validate your order. Consequently, placing an order implies your full acceptance of these conditions without reservation.
Article 2 - Prices
The prices guaranteed to you are those displayed on the site at the time of ordering.
Prices are quoted in euros, dollars and pounds unless otherwise stated, and exclude shipping and handling costs.
Our company reserves the right to modify its prices at any time. These modifications will be notified to the Buyer before any order is placed.
All orders will use the Paypal payment system via an account or payment by credit card.
Article 3 - Customs
Customs duties or other local taxes or import duties or state taxes may be payable in certain cases. These rights and sums do not fall within the competence of our company. They will be at the Buyer’s expense and responsibility (declarations, payment to the competent authorities, etc.). In this respect, we invite the Buyer to obtain information on these aspects from the relevant local authorities.
Article 4 - Orders
Any order implies acceptance of these terms and conditions, without prejudice to any special contractual conditions agreed between the parties.
Before validating the order, the Buyer can check the details and correct any errors.
The distance selling contract is concluded from the moment the Buyer confirms his/her order by validating payment. The customer is deemed to have accepted the content and conditions of the order with full knowledge of the facts.
Once this stage has been validated, the sale will be final (subject to the buyer exercising his right of withdrawal under the conditions set out in article 5 of these GTCS). The order will be confirmed to the buyer by an e-mail “Order Confirmation”.
Arabian Luxury Perfumes may at any time suspend or cancel any order or delivery, regardless of its status, in the event of non-payment, in the event of a payment incident, or in the event of fraud or attempted fraud relating to the use of the Arabian Luxury Perfumes website, including on the occasion of previous orders.
Article 5 - Product characteristics
The Buyer can view the main characteristics of the product(s) he/she wishes to order by clicking on the product sheet. The Buyer may select one or more products from the various categories on offer. In the event of stock shortages of certain products in the Buyer’s order, the Buyer will be notified by e-mail.
Due to possible constraints and stock shortages linked to suppliers, we may modify the assortment of products offered for sale on its site at any time, without prejudice to orders placed by the Buyer in accordance with article L. 111-1 of the French Consumer Code.
Article 6 - Availability
Our products are offered as long as they are visible on the www.Arabian-luxperfumes.com website and while stocks last. For products not in stock, our offers are subject to availability from our suppliers.
In case of total cancellation of the order.
- The Buyer’s order will be automatically cancelled and reimbursed.
- The buyer will be informed by e-mail.
In case of partial cancellation of the order:
- The Buyer’s order will be partially validated and his bank account will only be debited with the sums corresponding to the available products.
- The Buyer’s order will be partially cancelled and reimbursed for unavailable products.
- The Buyer will be delivered the available products.
Article 7 - Delivery
Products ordered by the customer will be delivered to the address indicated by the customer as the delivery address on the order concerned (“Delivery Address”).
On delivery, a delivery note or acknowledgement of receipt must be signed by the purchaser or order recipient. This acknowledgement of receipt is equivalent to taking delivery of, and receipt by the Buyer or the recipient of the order, of the products ordered.
If the parcel cannot be delivered, particularly if the Purchaser or the recipient of the order is absent, the Purchaser or the recipient of the order will generally receive a delivery notice. This notice will enable the Purchaser or recipient to reschedule the delivery time or to collect the parcel from the depot indicated on the document.
However, these procedures vary from one country to another. The Buyer is invited to consult the tracking of his parcel, which will be sent to him when his order is dispatched by our services.
Article 8 - Warranty
All our products are covered by the legal guarantee of conformity (articles L217-4 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). In the event of non-conformity of a product sold, it may be returned, exchanged or refunded.
Products modified, repaired, integrated or added by the Buyer are excluded from the warranty. The warranty does not apply to apparent defects. The warranty does not cover products damaged in transit or due to misuse.
All claims, requests for exchange or refund must be made by mail within 14 days of receipt of the package by the Purchaser.
Products must be returned to us in the condition in which the Buyer received his/her order, with all elements (accessories, packaging, etc.).
Article 9 - Withdrawal
The Buyer may only exercise his right of withdrawal upon receipt of his order. The product(s) for which the Buyer wishes to exercise his/her right of withdrawal must be returned in a condition suitable for resale (product in perfect condition, in original packaging, unused or undamaged, accompanied by accessories, samples, instructions, etc.). If the Purchaser has benefited from an offer against purchase on the site, entitling him, subject to conditions, to one or more products offered in return for his order, and if, as a result of exercising his right of withdrawal, he is no longer eligible for the offer in question; the Purchaser must then send the product(s) he wishes to return together with the product(s) offered received in return for the order of the product(s) returned.
In accordance with article L. 221-18 of the French Consumer Code, the Buyer has a period of 14 days from receipt of the products to exercise his or her right of withdrawal, with no obligation to state reasons.
However, the right of withdrawal does not apply to products unsealed for reasons of hygiene or health protection, in accordance with article L.221-28.
The Buyer must return the products to the professional within 14 days of his decision to withdraw, and in compliance with the conditions specified.
If these conditions are met, the Buyer will receive a refund of the products and delivery costs, in accordance with article L221-24 of the French Consumer Code.
Refunds will be made by the original method of payment or by any other means agreed with the Purchaser.
Article 10 - Intellectual property
Arabian Luxury Perfumes is the exclusive owner of the https://arabian-luxperfumes.com website and all its contents. Any unauthorized reproduction, modification or use is strictly prohibited.
Article 11 - Liability
11.1 – LIMITATION OF LIABILITY
The liability of Arabian Luxury Perfumes is limited to the obligations defined in the GTC and cannot be engaged in case of force majeure or events beyond its control.
11.2 – BUYER’S CAPACITY
The Buyer declares that he/she has full legal capacity to place an order. Arabian Luxury Perfumes does not verify the legal capacity of its visitors and Buyers.
